In general, social criteria play a very important role in the procurement policy of the city of Bern. The foundation of Bern’s procurement policy is the strict Swiss procurement law, which the city of Bern  insists on applying fully and correctly. ILO conventions are included as procurement criteria. The Bern procurement authorities recognise, however, that the effective compliance with ILO conventions throughout the supply chain is very difficult to achieve. Insufficient verifiability of compliance is identified as the main obstacle to the complete implementation of ILO conventions.

In 2010, a call for tenders for IT hardware was put out – with as closing date 2 August 2010. In this call, under detailed product description, reference is made to the ILO Conventions, as well as to Life Cycle management requirements. Moreover, under selection criteria (Eignungscritirien), tendering companies are requested to fill a bidders declaration (Formular Ethikkodex nach ILO or Selbstdeklaration der Sozialethik von Herstellern von Informatik-, Telekommaterial und Hardware) . This form refers to the ILO Conventions, and offers nine questions which tendering companies have to answer in the confirmative in order to qualify for the tender.
